These Terms and Conditions ("Terms") govern your access to and use of the salk.ai website and Salk AI Studio (the "Service") operated by Salk AI Private Limited ("Salk," "we," "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity, any name that is not lawfully available for use, or any name that is otherwise offensive, vulgar or obscene.
User Content
Our Service allows you to upload, generate, store, and share content including images, video, audio, and text ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Service. By uploading or generating User Content, you grant Salk a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify, and display that content solely for the purpose of operating and improving the Service.
You represent and warrant that:
- You own or have the necessary rights to the User Content you upload and the right to grant the licence above.
- Your User Content does not infringe the privacy, publicity, copyright, trademark, or other rights of any third party.
- Your User Content does not contain unlawful, defamatory, obscene, or otherwise objectionable material.
AI-Generated Output
The Service uses generative AI models, including third-party models, to produce images, video, voiceover, and other outputs. Because of the probabilistic nature of these models, outputs may be inaccurate, inappropriate, or similar to outputs generated for other users. You are responsible for reviewing any AI-generated output before using or publishing it, and for ensuring that your use complies with applicable laws and the terms of any third-party model provider.
Subject to your compliance with these Terms and payment of any applicable fees, Salk assigns to you all rights it holds in the AI outputs generated for you, to the extent such rights are legally assignable.
Acceptable Use
You agree not to use the Service to:
- Generate or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy.
- Impersonate any person or entity, or produce deceptive deepfakes of real individuals without their consent.
- Create sexual content involving minors or any other content that exploits or endangers children.
- Infringe any patent, trademark, trade secret, copyright, or other intellectual property right.
- Attempt to reverse-engineer, decompile, or extract the underlying models, prompts, or source code of the Service.
- Interfere with or disrupt the integrity or performance of the Service, including by circumventing rate limits or credit caps.
Credits & Billing
Certain features of the Service are metered in credits. New organisations receive a starting credit balance; additional credits may be purchased through the Service. Credits are non-refundable except as required by law, and unused credits may expire in accordance with your plan. We may adjust pricing from time to time and will give reasonable notice of any changes that affect your subscription.
Third-Party Services
The Service integrates with third-party providers for authentication, storage, and AI model inference. Your use of those services may be subject to additional terms imposed by the respective providers. Salk is not responsible for the availability, accuracy, or practices of any third-party service.
Intellectual Property
The Service and its original content (excluding User Content and AI outputs generated for you), features, and functionality are and will remain the exclusive property of Salk AI Private Limited and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Limitation of Liability
In no event shall Salk, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
